1. About us

The My PCOS Fit service (the "Service") is operated by BYBY FITNESS ("we", "us", "our"). By creating an account or continuing to use the Service, you agree to be bound by these Terms & Conditions ("Terms"). If you don't agree, please don't use the Service.

2. Who can use the Service

You must be at least 16 years old (or the age of digital consent in your jurisdiction) to use the Service. If you use the Service on behalf of an organisation, you confirm you have authority to bind that organisation.

3. What the Service provides

My PCOS Fit is a digital fitness product offering cycle-synced workout templates, routine tracking, and educational content aimed at women with PCOS. It is not medical advice. Consult a qualified healthcare professional before starting any new fitness or nutrition program, especially if you have a medical condition.

4. Your account

You are responsible for keeping your account credentials confidential and for all activity on your account. Notify us immediately if you suspect unauthorised access. You must provide accurate information and keep it up to date.

5. Acceptable use

You must not misuse the Service. In particular, you must not:

• use the Service for any unlawful, fraudulent, or harmful purpose;
• infringe anyone's intellectual property or privacy rights;
• upload malware, probe for vulnerabilities, or interfere with the Service's security;
• scrape, reverse-engineer, or attempt to derive our source code;
• resell, sublicense, or redistribute the Service without our written permission.

6. Intellectual property

The Service, including all software, content, branding, and documentation, is owned by BYBY FITNESS or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service for personal, non-commercial use within your active subscription.

7. Payments, subscriptions & Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment terms, billing, taxes, cancellations, refunds, and related mechanics are governed by Paddle's Buyer Terms and our Refund Policy.

Subscriptions renew automatically at the end of each billing period until cancelled. You can cancel at any time from your account.

8. Service availability

We work to keep the Service running smoothly, but we do not guarantee uninterrupted or error-free performance. We may perform maintenance, add or remove features, or modify the Service at any time.

9. Suspension & termination

We may suspend or terminate your access if you materially breach these Terms, fail to pay, create security or fraud risk, or repeatedly violate our policies. On termination, your right to use the Service ends and we may delete your account data after a reasonable export window, subject to any legal retention obligations.

10. Disclaimers

To the fullest extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Fitness and nutrition information is general in nature and is not a substitute for professional medical advice.

11. Limitation of liability

To the fullest extent permitted by law, our aggregate liability arising from or related to the Service is limited to the amounts you paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability that cannot be limited under applicable law (such as for fraud, death, or personal injury caused by negligence).

12. Indemnity

You agree to indemnify and hold us harmless from claims arising out of your content, your unlawful use of the Service, or your breach of these Terms.

13. Governing law

These Terms are governed by the laws applicable at BYBY FITNESS's principal place of business. Disputes will be brought before the competent courts of that jurisdiction, subject to any mandatory consumer protections you enjoy under local law.

14. Changes

We may update these Terms from time to time. Material changes will be notified via the Service or by email. Continued use of the Service after changes take effect constitutes acceptance.
